Terms and Conditions – Manahee Design
Preamble
These terms and conditions are entered into between eBizness Services, a simplified joint stock company with a share capital of €5,000, headquartered at 6 Rue Sodbronn, 67400 Illkirch-Graffenstaden, registered with the Strasbourg Trade and Companies Register under number 808 098 354, operating the website www.manahee-design.ie, and any natural or legal person making a purchase on the said website, hereinafter referred to as the "buyer".
Article 1 – Purpose
These terms govern the sale of products on the website www.manahee-design.ie. Any order implies the buyer's full and unreserved acceptance of these terms. eBizness Services reserves the right to modify the terms at any time. The applicable terms are those in effect at the time of the order.
Article 2 – Products
The products offered are those listed on the website www.manahee-design.ie, within the limits of available stocks. Each product is described as accurately as possible (photos, texts, technical sheets), but images are not contractually binding.
Article 3 – Prices
Prices are listed in euros, inclusive of all taxes (including VAT). Shipping fees are included unless otherwise stated. eBizness Services reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time of the order.
Article 4 – Orders and Payment Methods
The buyer may create a customer account to place an order. The following payment methods are accepted:
- Bank transfer
- Secure payment via PayPal or credit card (PayPal interface)
- Direct secure credit card payment
- Secure payment via Stripe
Any confirmed order constitutes acceptance of these terms. The order confirmation sent by email serves as proof of the transaction.
Article 5 – Retention of Title
Products remain the property of eBizness Services until full payment has been received.
Article 6 – Right of Withdrawal
For consumers, a right of withdrawal applies for 14 days from receipt of the goods in accordance with Article L221-18 of the French Consumer Code. Return shipping costs are the buyer's responsibility. Only unused, unassembled products in their original packaging will be refunded. The withdrawal form is available here.
For business buyers, the right of withdrawal does not apply unless the contract was concluded off-premises, the subject of the contract does not fall within the main business of the professional, and they employ five or fewer employees (according to Article L221-3 of the French Consumer Code).
Article 7 – Delivery
Delivery is made to the address indicated when ordering. Depending on the size and weight of the package, different carriers are used. A tracking number will be provided. In case of damaged goods, the buyer must notify the seller within 3 days via email to: customer-service@manahee-design.com. The buyer must check the condition of the packaging and the contents upon delivery in the presence of the carrier.
Article 8 – Warranty
All products are covered by the legal warranty against hidden defects (Articles 1641 ff. of the French Civil Code). Complaints must be submitted within 14 days of delivery by email to customer-service@manahee-design.com. Returns are accepted only with prior approval.
Article 9 – Liability
eBizness Services is not liable for damages resulting from the use of the internet, including service interruption, external intrusion, computer viruses, or other cases of force majeure.
Article 10 – Intellectual Property
All elements of the website www.manahee-design.ie are protected by copyright, trademark, or patent laws. Any total or partial reproduction is strictly prohibited.
Article 11 – Data Protection
eBizness Services is committed to maintaining the confidentiality of data provided by the buyer. Under the French Data Protection Act of January 6, 1978 (as amended), the buyer has the right to access, correct, and object to personal data concerning them. This right can be exercised by email to customer-service@manahee-design.com.
Article 12 – Dispute Resolution
These terms are governed by French law. In case of dispute, an amicable solution will be sought first. Failing that, the French courts will have jurisdiction.
